Quick answer: You must apply to the country that is your main destination, not the one with the earliest appointment. Main destination means where you will spend the most nights. If the nights are equal across two or more countries, you apply to the country you enter first. Applying to the wrong consulate from Dubai is one of the most common reasons a file is rejected as inadmissible or refused outright, and it is entirely avoidable.

The rule, in plain terms

The Schengen area has 29 member states but one shared set of visa rules. Those rules say which consulate is competent to decide your application. The test runs in this order.

First, if you are visiting only one Schengen country, you apply to that country. There is no ambiguity and no choice. Second, if you are visiting several countries, you apply to the country where you will spend the longest, measured in nights. That country is your main destination. Third, if you cannot identify a single longest stay because the nights are equal, you apply to the country whose external border you will cross first on entering the Schengen area.

Notice what the third test is not. It is not about your first flight. If you fly Dubai to Frankfurt and transit airside to Lisbon, you have not entered Germany. Your first entry is Portugal, because that is where you clear immigration. Airside transit does not count as entry.

The last row surprises people. The main destination test counts nights, not importance. A short business trip attached to a longer holiday does not make the business country your main destination. If the purpose genuinely differs, be ready to explain the whole itinerary honestly rather than reshaping it to fit a consulate you prefer.

Why people get this wrong from Dubai

Almost always because of appointments. In busy months the UAE market runs short of slots, and the temptation is to apply wherever you can get in. Both are useful, but neither is a licence to apply to the wrong country.

The second reason is a genuine misunderstanding of transit, as above. The third is people rewriting their itinerary to match an available appointment and then travelling on the real plan. That is a poor idea. Your entry is now recorded digitally under the Entry/Exit System, so a pattern of entering somewhere other than the country that issued your visa is visible, and we cover what that system records in our note on EES border queues in Europe.

What happens if you apply to the wrong country

One of three things. The visa centre may spot it at submission and tell you, which is the good outcome because you lose only time. The consulate may accept the file and then refuse it as not competent, in which case you have lost the fee and the appointment slot. Or the visa is issued and you then have a mismatch between your visa and your actual travel, which can cause problems at the border and at your next application.

Where you apply in the UAE, country by country

Once you know the country, you still need to know where to physically go, and this trips people up because the arrangements are not uniform.

France has no visa application centre in Dubai. VFS lists Abu Dhabi for the whole of the UAE, so Dubai residents travel there. Spain does not use VFS at all; it uses BLS International, with centres at I Rise Tower in Barsha Heights (Tecom) in Dubai and Tamouh Tower on Al Reem Island in Abu Dhabi. Italy runs a centre in Dubai but it serves only Dubai and the Northern Emirates, so Abu Dhabi and Al Ain residents go elsewhere. Germany operates a waitlist rather than open booking, and splits Dubai and the Northern Emirates from Abu Dhabi and Al Ain.

Plan the itinerary first, the appointment second

The right sequence is to fix your destination country, then look at availability, then decide whether the dates work. If they do not, the honest options are to move your travel dates, to genuinely restructure the trip so that a different country becomes your main destination, or to accept a later trip. Frequently asked questions

Can I apply to any Schengen country if the dates are equal?

No. If the nights are genuinely equal across countries, the rule points to the country of first entry, meaning the first place you clear immigration. It is not a free choice.

Does a long airport layover in another Schengen country count?

If you stay airside in the international transit area, you have not entered and it does not count. If you clear immigration and leave the airport, you have entered and it does.

What if my plans change after the visa is issued?

Genuine changes happen and are not in themselves a problem. What matters is that the plan you submitted was truthful when you submitted it. Deliberately submitting an itinerary you do not intend to follow is a different matter and can affect future applications.

I want to visit five countries roughly equally. What do I do?

Count the nights carefully rather than estimating. In practice one country almost always comes out ahead once you count properly. If it is truly a tie, apply to the country you will enter first.

Can I use a visa issued by one country to enter through another?

A uniform Schengen visa is valid for the whole area, so entry through another member state is permitted. The point of the main destination rule is which consulate decides your application, not where you may travel afterwards. That said, entering repeatedly somewhere other than your stated main destination invites questions at the border and at your next application.
